Who can I contact about a major issue ina house I have bought?

I bought a house in the Netherlands in October 2021. My mortgage advisor arranged an inspection and advised us on an insurance provider.
On 21 November 2023 we had a large amount of rain and one of the rooms are now flooding from the water coming through a gap between the wall and floor.

I contacted the insurance company, which just said it is groundwater, and they are not paying for the repair. I also spoke to my legal insurance and because they are part of the same group they told me to reach out to the seller, who denied having knowledge of this issue despite living here for 15 years.

Is there anything I can do legally to get any kind of financial restitution for the repair?

In the Netherlands, when you encounter a major issue with a house you've purchased, you have a few key resources available to you.

1. Seller: Your first point of contact should typically be the seller of the house or the real estate agent you worked with. According to Dutch law, any defects should be reported during the selling process. If this didn't happen, it could be a case of latent defects. You may be able to claim compensation from the seller.

2. Legal Advisor: If your issue is not resolved with a direct conversation, you might want to seek legal advice. A legal advisor can guide you through the process and help you understand your rights and potential next steps based on the specifics of your situation.

3. Building or housing inspector: This professional can provide a detailed assessment of any issues or defects. Their professional opinion can be crucial evidence if you need to take legal action.

4. Mediators: If you prefer a more neutral approach, mediators can assist in settling a dispute between you and the seller or the real estate agent.

5. Courts: If all else fails, you have the right to take your case to court. A judge can provide a final decision on your situation based on Dutch law.

Please remember, handling these issues can be complex, and seeking professional advice is always recommended to ensure a better understanding of all the legal aspects. Always document everything related to your case to provide proof if needed.
