Possibility to terminate rental contract earlier?
My partner and I have been living in this place for over a year and half now. Our initial contract started on October 2021 and was set to last for a period of 12 months. On October 2022, we renewed the contract for another 12 months (expected to end on October 2023). However, during this time, we found an opportunity to buy a place of our own (with a mortgage) and we need to move out from our current place by May 2023.
I contacted the owner of our home and he said that the contract cannot be void until October 2023, and if we do not find new tenants for him, then we would need to continue paying the rent until the stipulated end of the contract (October 2023).
I have read the Dutch Civil Code, and it clearly says that we can terminate earlier if we give one month notice. However, my contract's first clause states that our rent type does not adhere to these codes? Here I attach what the lease contract says:
"NEMEN HET VOLGENDE IN AANMERKING:
Partijen kiezen, mede met het oog op de investeringen die zij in het kader van deze huurovereenkomst doen, nadrukkelijk niet voor de mogelijkheid van een kortdurende huurovereenkomst, maar voor een langdurige(re) en bestendige (re) huurrelatie welke minimaal twaalf (12) maanden zal duren).
Partijen kiezen nadrukkelijk om geen gebruik te maken van het huurregime van twee (2) jaar (zelfstandige woonruimte) of vijf (5) jaar (onzelfstandige woonruimte) of korter ex artikel 7:271 lid 1 Burgerlijk Wetboek; deze huurovereenkomst kan gedurende de minimumtermijn van twaalf (12) maanden niet tussentijds door partijen worden opgezegd, omdat deze huurovereenkomst niet valt onder het huurregime van twee (2) jaar (zelfstandige woonruimte) of vijf (5) (onzelfstandige woonruimte) of korter ex artikel 7:271 lid 1 Burgerlijk Wetboek;
aan huurder komt huurbescherming toe vanaf aanvang huurovereenkomst;"
Does this mean I signed my rights away to terminate the contract earlier? Or does the Dutch Civil Code prevails over is shown here?
