Incorrect tax payment due to misinformation end contract.
I am reaching out to you because I am currently facing an issue with the Belastingdienst caused by my previous employer, as I have been asked to pay taxes for a contract that was supposed to be ended on 2021.
I had a contract that was ending on 27th of February 2022.
I sent to the manager an email on the 10th of November 2021 with my resignation letter, where I wrote that my last working day would have been the 29th of December 2021, but they did not end my contract and even did not communicate it to the Belastingdienst.
The company did some payment on 2022:
Date of payment: 12th January 2022 - End of Year bonus 2021
Date of payment: 21st January 2022 - Last salary 2021 + Holidays 2021 (but the amount was wrong - so they made another payment on 22nd of February 2022 to compensate the previous mistake)
On all those payment the description was always salary, but never received any payslip for those last payments and I could no access to my personal area any longer.
However since they payed me on 2022 and they did not communicate my end of contract, now it looks like I had two jobs on 2022 for which I have now to pay extra taxes.
The company gave me also the jaaropgave for 2022 where is written that my end of contract is 27 of February 2022 so not taking into consideration my resignation letter sent on November 2021.
As soon as I realised the mistake I raised this to the manager, even because according to my new contract I shouldn’t be performing more jobs at the same time, however she told me that it wouldn’t be a problem in any case.
Then I had a call with Belastingdienst and they actually explained me that this caused the issue as if my contract would have been closed by the date I gave my resignation, I should not pay anything now.
So basically it seems that the mistake has been made by my previous employer.
I have already asked the company to change the jaaropgave but I would like to know if there is some way I can push to them to take care of this issue as it was their mistake.
Would you be able to suggest me what to do in this case and support with this matter?
