How to file a subpoena in order to get a refund?
Here is my situation
- I've ordered on 09/08/2022 a video game console PS5 and paid 649,95 euros for it to the company/website TI-84shop
- I've canceled my order on 16/08 and asked for a refund according to their Terms and Conditions
- I have never received the console and was never refunded of the 649,95 despite several requests by email
- I have contacted the Geschillencommissie Thuiswinkel to settle the dispute, according to their Terms and Conditions. The Geschillencommissie Thuiswinkel came back to me saying that you were not registered with them anymore. Which means there is false information in their Terms and Conditions
I have contacted the Juridisch Loket, who advised me to hire a lawyer in order to file a subpoena. I got a lawyer on the phone who told me that it would be probably too expensive for me given my income, and advised me to contact you. I hope you can be of any help here. I'm also ready to pay a reasonable fee for this if it can help. Any advice is welcome.

Sorry to learn that you have not yet received your money. This dispute falls under consumer law. You can ask for your money back and this can indeed be done through a summons procedure. Before that can take place, the other party must first be served with a written notice of default, after which a summons can be issued.
