Graag zou ik een advies willen over het gebruik van fotomateriaal op mijn websites. Ik word exclusief distributeur van een productassortiment en de fabrikant stelt 2 websites beschikbaar waar deze producten op worden verkocht. Mag ik deze fotos vrij gebruiken als de fabrikant hier toestemming voor geeft of moet ik de foto's ook inkopen bij de bron waar de fabrikant ze vandaan heeft?

Regarding the graphic designs and images of the 2 theme websites: There is a new law on image rights and we were informed that it is not enough to just buy images but that the owner of the image has to be mentioned in the legal info of the website. This means that you would have to buy all images that appear on the theme websites as your company's name appears in the legal info. Due to the fact that this is new to us as well, we are now collecting all information and sources of all images as we need to adjust our websites as well. We are not sure to what extent this new law is being monitored in other countries but in Germany it is a current topic at the moment and people are actually sued. So if you prefer to use other images, that would be fine too. If you choose to use the images we are using, we will provide you with all sources so you will be able to purchase them."
Graag verneem ik van u of het voor mij noodzakelijk is om de afbeelding te kopen of dat ik voldoende heb aan de toestemming van de fabrikant.

U heeft niet genoeg aan die toestemming van de fabrikant en u loopt grote risico's als u de foto's toch gebruikt. Bedrijven als Getty Images hebben zoekrobots op internet om gebruik van foto's op te sporen en schakelen - ook in Nederland - met grote regelmaat advocaten in om claims neer te leggen bij gebruikers van foto's.
Wees dus voorzichtig!
