Early termination of 12 month contract possible?
I recently moved in to an apartment where I had 3 separate viewings in the same building and each time I was told that this building is for people over the age of 60 and that they only rent to younger people without children if they can not find an elderly tenant. They said this was to create a peaceful and quiet environment.
After moving in I found out this was a lie. Both my upstairs and next door neighbour have children and unfortunately the noise nuisance is incredibly high. I have migraines and I chose this building because I need a quiet place to live. I signed a contract with a minimum 12 month period. Can I terminate the contract early on the basis of 'dwaling' since my decision to rent was influenced by a lie I was verbally told by the landlord? I also heard that I can terminate the contract early without paying the full 12 month rent due to Dutch Law, irregardless of the reason, is this true?
If I can't, what can I do legally to deal with the noise? I have talked to my upstairs neighbour but they have been hostile. I asked if they could stop running all day or wear soft shoes or lay carpet but they said the noise is not their problem. I contacted the landlord but heard nothing.
I suspect my upstairs neighbour does not have proper sound insulation for their floor, is there a way I can legally ask for this to be investigated by the landlord or municipality so they can be officially ordered to put the right sound insulation?
