Dismissal agreement allowed during permanent contract?
I've got a dismissal agreement last Tuesday, 21st Feb.
I am employeed by consulting firm where I am able to get the permanant contract. After a roll-off from my previous project, I was not able to onboard other projects and it has been almost 5 months now. During the bench time (5 months), I am supposed to apply for the roles or get training to get staffed easily. I've applied roles both our cluster job area and also outside. Also, I obtained one certification from the training. During this time, I've got limited support (as I am thinking now), as it is hard to find a project as a junior and I have not heard any warning sign either from my work coach or HR. However, the company thinks that I am not performing enough by saying 2 things: 1. I've got no concrete project offer even though I've been looking for project out side of the cluster. So, your skills do not match with working at our consulting firm. 2. You are not performing well since you've got your certification after a year of employment.
In this case, I am wondering what will be the legal position
1. What is my current legal position? Do I say no?
2. What if I reject the agreement, am I in the legally vunlerable situation?
3. They are going to put me in Low performance improvement program. What if I failed to achieve? Am I in vunlerable situation?
4. What is the option that I can take during the consultation process with HR?
5. How far I can negotiation with my agreement? What is the average compensation amount here?
6. What is the thing that I should do right now? Do I need to get feedback why they come up with this conclusion and documentation it?
7. Is it legit to offer this type of agreement when employee has permanent contract?
8. What if you did not hear any warning sign, what usually the time period that employer should let me know that I should improve more?
9. I am holding working visa, what happen if I lay off?
10. Is there a chance to negotiate with my working visa state?
11. I am currently also looking for internal transfer. Is there a chance that our group will inform another group where I might get transferred?
12. What happen if the transfer cancelled because of their bad input?
