Voluntary Resignation? Discover the Consequences and Advice
Questioner
I am currently working for a BV, and I have been asked to voluntarily resign and re-enter the employment of a newly established BV. This was proposed by the owner of the holding company in order to remain personally unaffected in the event of bankruptcy. Of course I understand his position, but what are the consequences for me. (Unemployment benefits, pension, etc.)Lawyer
If you resign voluntarily, you also take the risk that if things don't go well with an employment contract at the new BV, you will not receive unemployment benefits. You do not write how that resignation is arranged. That is important. Your pension accrual then stops and could start again in the new BV. Based on your information, this answer is very general. yours sincerely,Lawyer
In addition to the above, I note that you can also lose your years of service (important for any severance pay in the future). Based on what you are writing now, I must strongly advise you against agreeing to anything. And certainly not by giving notice yourself as you indicate. For further advice/assistance, you can contact one of the employment lawyers here directly without obligation, e.g. via the 'direct contact' link that you will see with this answer if you are logged in. I'm happy to help you with this.Neem de volgende stap
