Questioner

My ex left our owner-occupied home with a letter on the kitchen counter at the beginning of December. Within 6 days he rented another home. I have no income and cannot buy the home and want to move to a rental home myself. To what extent can I force him to return to the owner-occupied home so that I can move into a rental home myself. The agreement states that he is responsible for the mortgage interest and owner's charges. It also states that I will remain in the owner-occupied home until it is sold and transferred or if I have found another home. So in short, I am within my rights to let him return to the owner-occupied home and rent it myself. I am also prepared for him to buy me out.

What is determined in the covenant is decisive. As long as the covenant has not been officially registered, then nothing is official. It is best to consult your lawyer about what is best in your case at this time.
