Collection agency requests additional documents?
Questioner
It seems that the collection agency wants to see financial evidence to enter into a payment arrangement. They probably want to make sure that you are able to make the proposed payments and that this arrangement will not lead to further debt. Although you are not required to provide these documents, refusing to do so may impact whether your payment arrangement proposal is accepted. If you are concerned about sharing this information, you may find it more comfortable to consult with an independent debt counsellor, lawyer or attorney. They can help you gain insight into your financial situation and negotiate an arrangement that is feasible for you and acceptable to the debt collection agency. Leaving the debt unpaid or ignoring it could ultimately lead to further costs and possible legal action, so it may be wise to seek professional advice to ensure you handle this situation in the best possible way. If you decide not to provide the requested information and the collection agency continues to insist on full payment, they can try to recover the full amount through the court. In such a situation, you definitely need a lawyer or legal expert. Above I read your response to my previous question why a collection agency asks me to send documents. I can certainly comply with the arrangement of 100 euros. This agency is NVI certified? I have already indicated several times that I would pay 100 euros monthly. They ignore my request for an arrangement on all sides and continuously ask for my pay slip overview of my bank savings account etc. I have already indicated several times that I would not send this, and that I would pay 100 euros monthly. Now they summon me to pay the entire sum within 14 days. I will absolutely not succeed. I have again emailed that I can pay € 100 monthly in any case. I have a permanent job and they do not need anything from me to make a vtlb calculation, I do not have any financial problems. What should I do now?Lawyer
A debt collection agency may not ask you for financial data or bank statements. We have permission for that. What is done to you is a means of pressure and a debt collection agency may not do that either. Coercively collecting a claim is punishable. You could annul the legal act of the debt collection agency and go directly to the creditor to make the payment after all.
