Legal assistance with stop and alcohol checks

Questioner

I was recently stopped by the military police at the border for an alcohol check because I had red eyes (they were not bloodshot and there was nothing special going on, it was eight in the morning). I had to wait an hour until the guy came back from the office with a breath test device. Of course I blew 0%. Question: is it allowed to stop someone for a breath test based on red eyes and nothing else? And is it allowed to take so extremely long?

Lawyer

Yes, you may be stopped and blown. The red-rimmed eyes give a (first) suspicion of guilt. You may then be arrested for investigation. Annoying that you had to wait so long, but consider the case closed now that 0% alcohol was found.
