Legally permitted notice period for closing a storage facility?
Questioner
The owner is closing the storage of my caravan on 31-12-2024, so I am forced to look for another storage facility this year. The owner charges storage fees until at least June 1 and then for every month that the vehicle is still there. I can move to another location as of March 31, 2024. I cancelled my contract as of 1-2-2024 and stated that I would be moving to another storage location at the end of March, but he still insists on 1 June. Is this possible? It was not my choice to cancel. According to the owner, he can cancel the contract up to 2 months in advance. I would consider it reasonable if I could do that too.Lawyer
In this case, there are two important factors to consider: 1. The contract: The terms you and the owner of the stable have agreed upon prevail in determining your rights and obligations, including the notice period. It is important to check your contract to see what has been agreed upon regarding the notice period. 2. Legal protection: Apart from the contractual agreements, there is a legal basis for rental agreements. According to Dutch law, a landlord cannot simply terminate a rental agreement and is bound by strict conditions. This applies mainly to homes, but can also be relevant for the storage of your caravan, depending on your specific situation. If there is no specific notice period in the contract, the statutory regulation will apply. In general, a notice period of one month applies to rental agreements concerning movable property, such as a caravan (Article 7:228 paragraph 2, part a, BW). However, this can be contractually agreed otherwise by the parties. The owner's remark that he can terminate the contract two months in advance raises questions. Unless this is specifically agreed in the contract, a landlord cannot in principle terminate a lease agreement prematurely with impunity. It seems that there may be unequal conditions in your situation. It may be wise to have this assessed by a lawyer or attorney, so that you can better assess whether your rights may have been violated. ---------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
