Transfer tax on purchase amount?

Questioner

My parents and I are selling the houses to each other. Our house is being demolished and the house that is going to be built on it is therefore occupied by my parents. Now it is more advantageous to have the transfer take place as soon as possible. Now we were called by the notary with the question whether we knew that 10% tax has to be paid on the purchase price. Because my parents are not going to live in the current house that is being demolished. We did not know this and now the transfer is not going ahead. But the purchase price is based on the new house, valuation report and we have had everything made. Is there still a solution here so that we can have the transfer take place as soon as possible?

In the Netherlands, transfer tax is usually due when real estate, such as a house or a plot of land without a house, is transferred. This is a tax that must be paid when the ownership of real estate is transferred to a new owner. For houses, the transfer tax is currently 2% and for other real estate, such as a plot of land without a house, it is 6%. There are, however, some specific situations in which you may be exempt from paying transfer tax. For example: 1. In the event of transfer of real estate within the family (depending on the specific circumstances). 2. If the property is acquired from a company in which you have an interest, under certain conditions. 3. If the real estate is included in the assets of a company, under certain conditions. 4. In the case of a donation, provided that certain conditions are met. The complexity and specific requirements for each of these situations varies and may in some cases require careful legal analysis. Please note: there are currently exceptions valid for starters on the housing market. They are exempt from transfer tax if they meet a number of conditions. Always check with a professional in the most recent context. This is general information and may not be complete or up-to-date. Therefore, it is advisable to seek specialized advice from a lawyer or attorney if you have specific questions or doubts about your situation.

I have investigated it further and have contacted the tax authorities. If they have started with the foundation, the transfer can take place at 2%. Maybe this will help someone else
