24/7 on-call service for reintegration?

Questioner

At the moment I am partially on sick leave and am reintegrating, building up with 2 hours per week to the end of 40 hours. I will soon be on call (24/7 on-call duty), but I am not yet working full-time (18 hours a week). My question is, am I allowed to 'work' this on-call duty even though I am not yet fully employed?

Lawyer

This may be arranged in your employment contract or in the collective labor agreement of the sector in which you work. If nothing is arranged, this falls under good employer practices. It is reasonable to assume that if you are partially incapacitated for work, you are not able to work a full on-call shift (24/7). It is important to discuss this with your employer and/or company doctor. I advise you to make this dilemma known to your employer and to discuss what the purpose of the on-call service is and whether you can take this into account during your reintegration. It may be wise to consult a lawyer or attorney for specific advice that is tailored to your situation. --------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
