Traffic fine justified?
Questioner
I recently received a fine from an employee of a waste processing company. I allegedly drove into a street in combination with a closed declaration for motor vehicles with more than 2 wheels, sign C 6 appendix I RVV 1990, https://www.google.com/maps/@51.9498356,5.2070291,3a,75y,101.05h,84.37t/data=!3m6!1e1!3m4!1sXSElouiNmLK3rkIaCFAqrw!2e0!7i16384!8i8192?entry=ttu What I remember is that I did not drive into the street, but turned around at this point. There was no stop, and I do not see any photo or other evidence. I objected, but it was rejected: By passing the sign I ignored the closed declaration. The fact that I then turned my vehicle around does not change that. Is it worth going to the subdistrict court for this?Lawyer
This largely depends on the evidence you can provide. If you can show that you merely turned around and did not actually drive into the street, you may have a valid argument. However, it is important to note that this is often difficult to prove without concrete evidence such as photographs or witness statements. What may complicate your case is the fact that your objection has already been rejected. This means that the public prosecutor has already assessed and rejected your argument, which may complicate the process in the subdistrict court. It may be useful to consult a lawyer or attorney before deciding to take your case to the subdistrict court. This can give you more insight into your chances of success, taking into account all the specific circumstances of your case. In addition, if the subdistrict court rules in your favor, the unjustified fine will be canceled. However, if the judge does not agree with you, the fine will remain in place and you may also be charged legal costs. Finally, it is important to know that the term for filing an appeal with the subdistrict court is six weeks after the date of the decision on the objection. You will therefore need to take action in a timely manner. Please note: the above answers are general and intended for orientation.
