Can the employer take away my TVT (time-for-time) hours?
Questioner
My employer has deducted hours from my work because I sometimes went home a bit earlier, because the job was finished and there was no other work for that day??!!! Is that allowed?Lawyer
According to Dutch law, time-for-time is allowed under certain conditions. This means that extra hours worked can be compensated in free time. That free time could then be taken later, for example if you go home early because the work is finished. If your employer has taken away your TVT hours because you sometimes went home early, it is important to check your employment contract and company policy to see if this is explicitly stated. If your contract or employer’s policy does not specifically address the withholding of TVT hours in these situations, it may be unlawful. However, it is important to note that the precise arrangements for TVT hours may depend on the individual employment contract, the collective labor agreement, if applicable, and the company culture. Since this is a complex legal issue, if you have any doubts, I advise you to contact a specialized employment law attorney or the legal help desk. -------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
