What to do when internet provider does not keep to agreements? Can I then cancel the contract?
Questioner
Mid-July '23 I had a visit from two people from internet provider XZY. They offered me a contract that was €34 per month cheaper than NPK, who supplied me with internet and TV. Duration 36 months. Would be confirmed in writing. I went into business with them. Afterwards it turned out that this was not fulfilled by XYZ. What I was told: 'These field staff are just shouting, we are confronted with it'. Phone calls later: 'They have been fired'. In the meantime the switch has gone through and there is still a fuss about what I have to pay. It seems like chaos. Four phone calls later lead to four different amounts per month. On November 24 I thought I had it figured out (the €35 cheaper was not reached for a long time, but I was fed up. Yesterday, December 19, this amount was outdated again and it became a lot more expensive again. I want to get rid of the contract and the fuss. XYZ does not keep to the agreements. Can I cancel this because of this??Lawyer
If a company like your internet provider does not adhere to the agreements in the agreement, then that is in principle a shortcoming in the fulfillment of the agreement. This could legally be a reason to terminate the agreement. In short, the agreement must then be reversed as if it had not taken place. Before you can terminate the agreement, you must first officially put the provider in default. You do this by sending a letter in which you explain that the provider is not adhering to the agreements and give him a reasonable period to solve the problems. If there are still problems after this period, you can terminate the agreement. In addition, it is always important to have evidence in these types of cases. So keep all communications you have with the provider, such as emails and letters, but also notes of telephone conversations. It may be helpful to seek the help of a lawyer or attorney specializing in consumer law to assist you with this process. It can be a complex issue and professional help can ensure that you have the best chance of obtaining justice. -------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
