Is Parking Space Offer Binding?

Questioner

I had a viewing for a parking space. I also asked if the space was suitable for a somewhat longer car. I was told that this was not a problem. After this, an offer was made. When I wanted to park the car afterwards, it turned out that you can only reverse into the space, with great difficulty. The purchase contract has not yet been signed, but the offer had already been made. Personally, I assumed that an offer can still be withdrawn within three days, which I also did by e-mail. At the moment, the seller wants to oblige me to the purchase, and I wonder what my options are.

Before you are obliged to purchase, there must be a valid agreement between you and the seller. An agreement is reached by offer and acceptance. In your situation, your bid can be seen as the offer and acceptance by the seller. However, according to the law, there is an exception for purchase agreements of real estate (including a parking space). These must be entered into in writing to be valid (Article 7:2 of the Civil Code). If there is no written agreement, you are therefore in principle not obliged to purchase. In addition, the seller must provide certain information about the parking space. If this is incorrect, or essential information is omitted, there may be a mistake. In that case, you can annul the agreement. In your situation I would advise to continue the communication with the seller and explain why you want to withdraw from the purchase. If the seller continues to insist, it may be wise to seek legal advice from a lawyer or attorney. -------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
