What are the rules for police searches?
Questioner
I am a member of the NABV and have some airsoft replica guns hanging on the wall (not visible from the street). someone brought a christmas tree and later informed the police and suddenly there were six officers inside with a search warrant. They didn't take anything but said that it shouldn't be hanging on the wall and that they would come back to check again if I had them in a safe. My question is, can they come more often in the future or at most one more time for a check-up? The strange thing is that I read that you can hang deactivated firearms on the wall. thank you for your info and advice.Lawyer
It seems that you have experienced a situation in which police officers have searched your home. The rules for police searches in the Netherlands are laid down in the Code of Criminal Procedure. In general, the police may only enter your home with a search warrant, unless there is a case of flagrante delicto. Regarding your question about repeated checks, there is no specific number of times noted in the law. The frequency of these checks may depend on the nature of the items found and the judgment of the police or justice. In your specific situation, it seems that the police have decided that your airsoft replica guns should be stored in a safe. Although you are a member of the Dutch Airsoft Interests Association (NABV) and are therefore allowed to own these airsoft replica guns, there are rules for their possession and transport. Airsoft devices should be stored in a way that prevents theft. This is often in a locked cabinet or safe. As for deactivated firearms, yes, they can be hung on the wall. However, there are strict rules on how to deactivate a firearm for decoration. In either case, I would recommend that you contact a legal professional who has experience in gun law for detailed advice. It is always their job to help you understand what you can and cannot do to avoid further legal trouble. ---------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
