Do we still have to pay alimony for a 21 year old with a job?
Questioner
My boyfriend and I pay alimony for his daughter. She will be 21 on December 20th. The parenting plan includes the following: Parents are obliged to contribute to her living expenses as long as her daughter is doing vocational training and/or studying, from the moment she is 21 or older until the moment she reaches the age of 25. However, since September 1st, his daughter has been working 30 hours a week and she follows a course once a week in the evening, 50% of which is paid for by her employer. Do we still have to pay alimony?Lawyer
Dutch law states that parents are obliged to contribute to the cost of living and education of their children until the age of 21. After this year, if the child is still studying or doing vocational training, the obligation to pay maintenance can continue until the age of 27. However, if you and your partner have explicitly included in the parenting plan that you will contribute to her livelihood as long as your daughter is doing vocational training and/or studying, this may have consequences for the maintenance obligation, since she is still following a training course. However, the actual implementation of the maintenance obligation may differ from case to case. This may depend on the specific factual circumstances, such as your daughter's income and the costs of her education. The development that your daughter is now working and her employer is financing part of her education, could possibly give rise to a reassessment of the maintenance obligation. In this context, it may be advisable to seek legal support to determine whether and how a reassessment can be requested. This is a complex situation and it is advisable to contact a lawyer or attorney specializing in family law for a comprehensive assessment and tailored advice.' ---------------- Stichting Rechtswinkel.nl is a national organization with students and volunteers.
