Rights in case of improper placement of a log cabin?
Questioner
We bought a log cabin, including installation, total costs 17,000 euros. The log cabin was custom made for us and we signed for all dimensions. The log cabin was installed by an external carpenter hired by the seller, is included in the 17,000 euros. After installation I stained it and the electrician installed the steam. Two weeks after installation we went to clear the canopy of the log cabin and discovered that the carpenter made the wrong wall on the wrong side, on one side of the door our jacuzzi came, that wall had to be 210 cm and the other side a garden set. Now because of the incorrect assembly of the log cabin our new garden set of 1300 euros cannot be there. The carpenter's solution was that he buys a new garden set for us of 1200 euros and he wants the new garden set that is no longer usable for us. Doesn't seem realistic to me. Before I give a counter-reaction I would like to know what we are entitled to.Lawyer
It sounds like you are in a difficult situation. Based on the information you have provided, it is advisable to know that under Dutch law, consumers are protected by law in such cases. The execution of the agreement must be in accordance with the agreement, in accordance with the requirements of good workmanship and in accordance with the expectations that you may have based on the agreement. In your case, the placement of the log cabin does not seem to be in accordance with the agreement, because the walls have been placed incorrectly. This is a breach of the agreement. The repair costs are normally borne by the seller, provided that you have notified them of this breach in a timely and correct manner. Keep all correspondence carefully and declare default if an appropriate solution is not forthcoming. The carpenter's proposal to replace the garden furniture with a new one does not seem to be a suitable solution, since this replacement does not make the situation as it was or should be according to the agreement. You could consider holding the seller liable for the costs of rebuilding the log cabin according to the original agreements. The first step would be to bring the issue to the attention of the seller and get a written record of your conversation. If you are unable to resolve the issue with the seller, you should consider seeking legal advice and possibly going to court to enforce your rights. Again, this is only preliminary advice and it is advisable to seek legal advice from a professional.
