Why extra notary costs?
Questioner
Hello, we are selling my mother's house, buyer's costs. The buyer has also selected a notary, on the sales settlement note an amount is now noted as other costs. Administration costs 20.00, Fee investigation power of disposition in connection with inheritance 375.00, costs BRP and legally required inspection(s) of bankruptcy and curatorship register (5x) 125.00, processing costs payment transactions (2x) 30.00 and then 21% VAT 115.50. Total 665.50. I find this strange, is this allowed. According to our own notary, they could have obtained a certificate of inheritance with 1 phone call to us. We also emailed this to them. Why then incur all costs without consultation, and then recover these costs from my mother and us the children. I also sent them an email explaining these costs. And then get the following answer: In this file we had to spend a lot of time investigating the inheritance, my colleague has already indicated this to your sister. In addition, we also had to inspect various registers of the heirs. Because of all this, we had to charge extra costs. (IS THIS ALLOWED) It is not reasonable to charge these costs to the buyer. The buyer will pay the deeds as agreed, these are the buyer's costs. Investigating inheritance etc. is not included. WHY ALL THESE INVESTIGATIONS IF THERE IS A DECLARATION OF INHERITANCE. We are therefore of the opinion that the costs charged for investigating the inheritance and for the various inspections at various registers have rightly been charged to the sale. I would like to hear your feedback. yours sincerely.Lawyer
In general, the notary costs for the deed of transfer and registration in the Land Registry are paid by the buyer (these are so-called 'buyer's costs'). However, the seller usually pays the costs for the cancellation of the mortgage ('cancellation costs'). Any additional notary costs, such as costs for additional services, are in principle paid by the party that requested the service. It is important to know that these are general rules, and the exact distribution of costs can vary depending on the agreements made between the buyer and the seller. These agreements are recorded in the purchase agreement. Consult your purchase agreement or contact a legal advisor to get clarity in your specific situation.
