Should a housing association repair groundwater or rising damp from the concrete floor?

Questioner

The Housing Association says they can't do anything about it, but my subfloor panels get wet every month, can't they replace a lot of base panels every month? They also say, give it to the insurance company, but they won't reimburse it. My question is, should the Housing Association fix it? Thanks in advance.

In general, a housing association is responsible for repairing structural problems with a property. This can include problems with groundwater or rising damp. In most cases, you as a tenant are responsible for minor maintenance tasks and everyday repairs. The housing association, on the other hand, is responsible for larger, structural repairs and maintenance. This often includes repairing problems with leaks, rising damp and other water damage. However, the exact division of responsibilities may depend on your tenancy agreement and the housing association’s terms and conditions. It may be useful to check these documents to see what exactly they say about these types of issues. If it is unclear whether the housing association is required to carry out these repairs, you may want to consider seeking legal advice. In addition, if you have already reported the problem to the housing association and they refuse to take action, you can start a procedure with the Rent Assessment Committee. They can then decide whether the housing association is indeed responsible for fixing the problem.
