Employee rights?
Questioner
I get a message the night before what time I have to work the next day, always after 5:00 PM. If I can't start at 7:00 AM all of a sudden, I get the message: hand in your resignation. And this is just a small example. What are my rights as an employee, I only have obligations.Lawyer
It is unreasonable and potentially illegal for an employer to inform you of your working hours so late. According to the Working Hours Act in the Netherlands, employees must be given sufficient time to recover from their work. This applies to both rest time between shifts and advance notice of your working hours. Your specific rights in this situation depend on your employment contract and any application of a collective labor agreement. Many collective labor agreements contain agreements on the period within which your schedule must be made known. These periods can vary from a few days to a few weeks. Additional rights as an employee include: 1. The right to salary: You are entitled to wages for the hours you work. The exact amount is usually agreed in your employment contract or in the collective labor agreement. 2. The right to a break: If you work longer than 5.5 hours, you are entitled to a break of at least 30 minutes. If you work more than 10 hours, the break must be at least 45 minutes. 3. The right to a safe workplace: Your employer is legally obliged to provide a safe and healthy working environment. 4. The right to refuse to work on Sundays: By law, you may refuse to work on Sundays, unless otherwise agreed in your employment contract or collective labor agreement. In the event of employment conflicts or uncertain situations, it is always wise to contact a lawyer or attorney who specializes in employment law.
