Stop renting out rooms in case of illness?
Questioner
Two months ago my father was diagnosed with metastatic lung cancer with the prognosis that he only has 6 to 8 weeks to live. In addition, he also shows forms of forgetfulness, mild dementia. Now it turns out that my father has been renting out 2 rooms in his owner-occupied home with a current mortgage for several years, but due to my father's weakened health, renting out the rooms is no longer possible for him. Also for his own personal safety, I want to stop the rental. Unfortunately, I can't find anything on the internet about terminating a rental due to chronic illness of the landlord and what the rights and options are. I hope you have some advice in this area.Lawyer
Dear Sir/Madam, I wish you much strength with your father's illness! It depends on the content of the rental agreement (type of rental agreement, duration of the rental agreement) whether you can terminate the rental agreement without grounds for termination. If the rental agreement cannot be terminated without grounds for termination (for example because the lease is for an indefinite period), a legal ground for termination must be found. These are stated in article 7:274 paragraph 1 of the Civil Code. The fact that your father is seriously ill is not a ground for termination included in the law. If you require personal advice on the legal options for terminating room rental agreements, please contact me at pjdejong@solutionsadvocaten.nl Yours sincerely, Mr. Pieter-Jan de JongNeem de volgende stap
