Liability for damage to old pond
Questioner
On May 13th, while removing an old pond (constructed by the previous occupant), I damaged the gas pipe under this pond, causing gas to escape. 'Company X' holds me liable for damages on the basis of article 6:162 BW in a letter received on July 6th, in which a damage amount of €2091 is mentioned without further specification other than an invoice of €221 for outsourced work. On July 11th, we received a letter with a specification of the costs and a request to transfer the amount before August 10th, otherwise interest and collection costs may follow. On July 29th, we received a letter with a payment reminder to pay the full amount by September 14th at the latest, otherwise €313.69 collection costs will follow. These letters were all sent during our vacation and because of this planning and pressure to pay such a large amount quickly, we are being forced to accept liability under pressure, while in our conscience this is an unfortunate coincidence.Lawyer
You will first have to be given the opportunity to repair the damage. Suddenly having the damage repaired by someone else without consultation or anything like that is wrong. Given that I have no further insight into the situation, it could be an emergency situation, but that is just guesswork at the moment. If you contact me further, I am willing to look into the case for you free of charge. You may also contact me via email address: groenewegenjuristen@gmail.com. If you have any questions, please ask.
