Forced contract change employer

Questioner

Good afternoon, I have been employed by a courier and transport company since 2007. I have a permanent contract of 16 hours per week. For several years now, my employer has been asking me to switch to a 0-hour contract. I was declared 80% incapacitated for work at the beginning of 2000 and have a benefit. I am 65 years old and will retire in 16 months. I would like to continue working for this employer until my retirement with my 16-hour contract. The reason that I would have to switch to a 0-hour contract this time is because of an upgrade in the hours registration system. It is then no longer possible to schedule me for approximately 16 hours.

Lawyer

The first 26 weeks of the employment contract, a zero-hours contract is possible. After these 26 weeks, this is only possible if it is included in a collective labor agreement. In your case, this is not possible because you have an employment contract for an indefinite period. As a result, your employer may not simply offer you a zero-hours contract.
