Who is liable for sewerage?

My mother lives on the ground floor of a senior citizen's flat, the sewer has already overflowed twice from the bathroom into the bedroom, so new carpeting is needed. The housing association indicates that they are not responsible for this and that it is because other residents above throw things into the sewer that should not be there. My mother has to sort it out with the contents insurance, but she doesn't have it! Now the housing association wants to pay 350 euros as a goodwill gesture, but for new carpeting the entire house had to be emptied, all the cupboards emptied and taken apart and put back together. The neighbours also spent 10 days in a hotel for the same thing, and in my opinion there is more to the sewer. Who is liable? Mother, housing association or upstairs neighbors?Lawyer
