Who is liable for damage to shared property?

Questioner

We have a shared property with quite a few neighbours. This is a field with trees, where some neighbours have placed all kinds of things. Including trampolines. The property has a VVE. What about liability? What if, for example, a child breaks his back because he falls off the trampoline? Is the VVE liable then? Or the neighbour who placed the things?

Lawyer

Determining liability in this situation can depend on several factors, such as the specific rules and agreements within the VVE, the property rights and the use of the shared land. It is advisable to consult the articles of association and the regulations of the VVE to see which responsibilities and liabilities are laid down therein. In general, it is possible that both the VVE and the neighbor who installed the trampoline can be held liable, depending on the circumstances and any negligence.
