NVM questionnaire not completed truthfully?
Questioner
The questionnaire completed by the selling party indicated that a new solar panel system was installed last year by an approved company, including a 10-year warranty. I contacted this company and they indicated that no data was available and that the solar panels were therefore not installed by them. Through the intervention of the real estate agent, we discovered that the solar panels were purchased second-hand by the selling party and placed on the roof in black. The supplier no longer provides a warranty and I therefore cannot say with certainty whether the installation has been properly and safely installed. In my opinion, I purchased an installation that was done by a professional company, including a 10-year warranty. The selling party indicates that it wants to buy out the warranty for a small amount. I believe that an inspection of the installation should take place at the expense of the selling party and that the warranty can indeed be bought off if the result is positive. What are my rights and obligations in this case? And what is a reasonable amount to buy out the warranty?Lawyer
Dear, In general, you have rights as a buyer when there is misleading information or hidden defects in the sale of a home. In this case, you have discovered that the solar panels were bought second-hand and were not installed by a recognized company, contrary to what was initially claimed. This can be considered misleading information. You may consider holding the seller liable for the consequences of this deception. It may be advisable to gather written evidence, such as correspondence with the company claiming not to have installed the solar panels, as well as the questionnaire filled out by the seller claiming that the solar panels are new and installed by a licensed company. You can request the selling party to cover the costs of an inspection of the solar panels. If the inspection shows that the installation is not properly or safely installed, you may consider taking further legal action to obtain compensation.
