Questioner

A company has made a quote for mounting a tow bar under our inherited camper. This is a 'special model' for € 1,200 because of the chassis. After a few test weekends we concluded that we do not like the camper of my deceased mother. We recently bought another camper and we also want a tow bar under that. This can be a normal model. The company now wants us to pay compensation for not taking the special model tow bar. However, I do not find any obligation to do so in the General Terms and Conditions. The tow bar has been paid by the company to their supplier but has not yet been mounted. Returning it to the supplier may be possible, but then we would still have to pay (part of the costs). I would like to hear your advice.

Good afternoon, In principle, a quote is not binding unless you have agreed to it. If this is not the case, the company cannot usually charge a penalty. It is also important whether the company could assume that it could order the part (in advance) at your request. In that case, you may have to reimburse (part of) these costs. All in all, all documents must be reviewed before specific advice can be given. Feel free to contact us without obligation to discuss your case further. Gr, Mr. Mr. S. Leito FerLei Legal 06-49175526
