Refund of down payment for solar panels

Questioner

'Company A' was supposed to install solar panels at our place in early March after the down payment of 2357 euros on 23 January. In March, an email from them said they were handing it over to another party because they had no fitters. The other party was supposed to come on 8 May, but called to cancel the same morning: no panels in stock. I could choose to install on 6 June or cancel the purchase and get my money back within 1 week (verbally promised by the person who called me that morning). I am still waiting for my money after several emails with 'Company A' and the other party. You do not get any promise of a refund, 'Company A' supposedly transferred my money to the other party according to someone from 'a certain company' (which apparently includes 'company A', not registered with the Chamber of Commerce). How should I handle this?

Lawyer

Good afternoon, In principle, you have a legal relationship with Company A and not with the other company. Furthermore, Company A chose to engage another company. If they are unable to comply, in most cases you can terminate the agreement and claim your money back. In order to be able to provide an answer in your specific situation, the documents (quotation, any general terms and conditions and correspondence between you and Company A) must be reviewed. The question is also what your wish is in this regard: wait until 6 June or cancel the purchase after all. Please feel free to contact us without obligation if you wish to discuss your case further.
