Is a verbal agreement binding?

Questioner

I am the secretary of a choir and we practice in a village hall. We have made a verbal agreement regarding the use of a hall for practicing. If that hall is not available, we have agreed that we will get another hall. This is allowed 3 times per season. Now the village hall has made an agreement with someone else and we as a choir cannot go to the village hall. Is that allowed?

Lawyer

Good afternoon, In theory, the following applies: in principle, verbal agreements are legally valid. You can ask the other party to comply with the agreement. However, if nothing has been recorded (e.g. by letter, via WhatsApp, recording of the conversation, e-mail, etc.) you cannot enforce a verbal agreement if the other party denies it. There is then no proof that anything has been agreed. In practice this means that if the other party denies that any agreements have been made, you cannot enforce anything. If you wish to discuss your case further, you can always contact us by telephone without obligation. Kind regards, Mr. Mr. S. Leito FerLei Legal 06-49175526
