Permission for contact via the judge in case of a ban on contact with grandchildren?
Questioner
My daughter forbids me to stay in contact with her children, my grandchildren. I think there is no reason for it and I don't understand why she does that. She does have some psychological problems. Can she forbid me to have contact with my grandchildren and if so, can I still apply to the judge for contact permission?Lawyer
Unfortunately, it is possible that your daughter will forbid you to have contact with your grandchildren, even without a specific reason. While everyone has the right to maintain contact with family members, the decision to have contact with children is ultimately up to the child's parent(s). However, if you believe that your daughter's ban is unreasonable and infringes on your right to a private and family life, you can apply to the court for permission to have contact with your grandchildren. The concept of 'family life' is a concept that refers to the ties and relationships that people have with their family members, such as parents, children, brothers and sisters. It is a fundamental human right protected by several international treaties, including the European Convention for the Protection of Human Rights and Fundamental Freedoms. If you file an application with the court, the court will assess the circumstances of your specific situation and take into account your right to a private and family life, as well as the best interests of the child. This may include, for example, setting a visitation schedule, or ordering the child's parent(s) to take certain steps to enable contact. It is recommended that you consult an attorney for further support and advice in your specific situation.Neem de volgende stap
