What can I do to get my mini shetland pony to me?

My mini Shetland pony is with my father (my parents are divorced) and my father doesn't allow me to see him and he's not allowed to take him with him. I got my mini shetland pony from the people where I was standing with my own horse at the time, now my father claims that he arranged for me to get it so that it is his. Now I haven't actually seen him since March and I just received a video from someone I know of my mini shetland pony, I personally don't think he looks good, he's only 4/5 years old. Now my question is what can I do to get my mini shetland to me? Do I have to have it in writing that I got him or? Thank you in advance! Kind regards
