What happens to property ownership after marriage?

Questioner

Woman owns home; she marries in community of property. Who then owns the home?

Lawyer

In the event that you and your wife are married in community of property, this means that all assets and debts of both partners are combined and that these are therefore also divided together in the event of a divorce. This also applies to the home that your wife already had before you got married. During the marriage, both partners own the home. If the marriage is dissolved, the home will be divided between the two partners. This could mean, for example, that the home is sold and the proceeds are divided, or that one of the partners buys out the other partner. Whether you are entitled to a buyout amount depends on the financial agreements made during the marriage and the division of assets and debts in the event of divorce.
