Get your car down payment back?

I made a down payment for a car yesterday. I only received the license plates after the down payment (I previously asked for the license plates but did not receive a response). After I received the license plates I applied for a parking permit, which I cannot get because I live in Delft. I filed an objection to this with the municipality. Given that I cannot get a parking permit I told the car dealer that I cannot buy the car because I could not get a parking permit. He now refuses to give me back the down payment. Is it possible to get this back? He gave me the license plates only after the deposit, so I couldn't apply for the parking permit before the deposit. Thank you in advance!
