When is a pet ban valid?
Questioner
I have recently moved into an apartment (70 square meters). It is a rental apartment and the rental contract (special provisions) stipulates that there is a ban on pets unless the landlord has given permission. Now I read online that this is only valid if it is a reasonable provision and therefore not a general provision. We want to buy a mini labradoodle and are wondering if this is possible. We also have a garden.Lawyer
Good afternoon, There is no separate provision for the use of such a in rental agreements. However, the landlord may agree this with you. In my opinion, it is not an unreasonable provision either. Since you have already signed the agreement, you have also agreed to this. The landlord can therefore hold you to this provision. However, you do have the right to undisturbed living pleasure. Being able to keep a pet could be considered living pleasure. If the landlord addresses you because you violate this provision, a judge could make a ruling. All circumstances are then taken into account: is the animal (too) noisy for the environment? is the home suitable? What is the interest of the landlord and what does the VvE think? These circumstances play a role, among others. In order to maintain good relations, it is advisable to discuss your wish with the landlord before taking action. After all, you also want to be able to get along with the landlord! Silvienne Leito FerLei Legal 06-49175526Neem de volgende stap
