Are additional provisions of contracts concluded by email binding?
Questioner
I have a 1-year employment contract with the CAO. I work as a System Administrator, and have confirmed a condition by email that they set for the contract. Namely: Obtaining my driver's license. However, this document/email cannot be found in my File with the employer and there is also nothing described about it in my agreement. May/can the employer see an agreement made with HR as binding to the contract? In saying that, do I have to adhere to it, if this is set as a condition for an extension with an indefinite contract? (confirmed by email and cannot be found in my file and employment contract)Lawyer
It does not matter how agreements are made, if both parties agree to the terms, then they are binding. Ultimately, it is about the ability to prove the agreements. If there is an email in which you both agree to these terms, then both parties will have to respect and comply with this agreement. If one of the parties does not do so, then the other may invoke the associated consequences. Success.Neem de volgende stap
