My husband's contract will not be extended. And expires on 30 Nov. Now he just worked through the summer and did not take any vacation. He had taken 1 week in the fall vacation for that and he wanted to take the other 2 weeks during the Christmas vacation. Now he wants to take the last 2 weeks of November these 2 weeks to be able to find other work. I know that if he does not take it, these hours will be paid, but we also know that a lot of tax will be deducted. Can he claim the last 2 weeks off?

Was there timely written notice that the contract would not be extended? If this did not happen, a notice fee can be claimed via the subdistrict court within 2 months after the end date of the employment contract. After those two months, this right expires. It is the employer who, in consultation with the employee, determines on which dates vacation can be taken. The starting point is that the wishes of the employee are honored, unless, in short, that is really not possible. This must be motivated by the employer. If, within two weeks after submitting the vacation request, the employer has not given a reasoned indication that taking vacation, in short, is really not possible, then the vacation is deemed to have been determined in accordance with the wishes of the employee. It is important that it can be proven when the vacation request was submitted. I would do this at least in writing and also by email in case the employer claims not to have received a vacation request.
