Dismissal rights in the case of a contract of employment?
Questioner
I have been working as a freelancer for a company since July, I signed a contract of employment here. However, this contract contains all aspects of an employment contract. I therefore understand that this applies as an employment contract. Now I have resigned as of October 11, I have worked there the entire month of October as I have done in previous months. Only now the company does not want to pay my invoice for October. I would like to know what I am entitled to and how I can ensure that I still get paid.Lawyer
Under certain circumstances, a contract of assignment can indeed be considered an employment contract. In that case, you may still have one or more claims against the (former) employer. In most cases, a collective labor agreement also applies from which various rights may arise. Whether there is an employment contract depends on various (relevant) facts and circumstances. Roughly speaking, there must be wages, the performance of personal work and a relationship of authority. The reason why your former employer/client does not want to pay your last invoice is not clear from your description. Are you aware of this? If there is a payment obligation, this can of course be enforced, if necessary via the court. In a contract relationship, you could also consider claiming collection costs and statutory (commercial) interest. If you would like to discuss this without obligation, please feel free to call (06-30575754).Neem de volgende stap
