What to do if you are ill during the termination agreement signing process?

Questioner

What to do if the termination agreement has not yet been signed and I have become ill in the meantime? I have agreed on a termination agreement with my employer. I should sign it today, but I have had Covid and am still tired, have hardly any energy. If I sign the agreement, it means that I will leave the company on 1 December. But I do not yet have a new job in sight, and I cannot apply for a job now due to my health. What do you advise me to do?

If you sign a settlement agreement during illness on the basis of which the employment contract is terminated by mutual consent, you may be running a great risk. If you were to apply for benefits, the UWV could possibly rule that there is culpable unemployment and that the benefit should be refused on that basis. If you sign a settlement agreement, you can legally terminate it within 2 weeks. If you are considering signing a settlement agreement, I advise you to seek advice from an employment law specialist beforehand. You may call me if you wish for consultation (06-30575754).
