Employer forces employee to work despite occupational health and safety doctor's advice?
Questioner
Employed since 22/8/22 with a one-year contract. Reported sick since 14/9/22. Company doctor would be informed after 10 days. 29/9/22 attempted to work at the insistence of employer; home after an hour. Emails and phone calls from employer that I have to integrate socially by coming for coffee 3 times a week. Am unable to drive myself: I have to arrange transport. Proposal made, after a few days there is a response an hour in advance, so no transport. Email with warning about wage sanctions. 17/10/22 intake by practice assistant occupational health physician. Makes appointment with occupational health physician on 15/11/22. She says that this situation is not conducive to my recovery, I agree. 17/10/22 Po occupational health physician sends email to employer that I am unable to work and that his actions are incorrect. 18/10/22 again mail from employer that I have to come for coffee or work, again with warning wage sanctions. What should I do? How do I get out of this well?Lawyer
For both employer and employee, the assessment of the company doctor regarding your usable possibilities is in fact leading. The employer cannot chart his own course here. The employer is not a company doctor. You must be available to your employer for consultation in the context of the reintegration, unless this is medically impossible according to the company doctor, but this does have its limits. If the employer seeks contact more than average, or perhaps even 'stalks' you, this may be in conflict with the obligation to behave as a good employer. If you would like to consult without obligation, please feel free to call me (06-30575754).Neem de volgende stap
