Transition cost compensation

Questioner

On March 1, 2011, I started working part-time for my now ex-employee. From March 2011 to October 2018 for 18 hours per week and after November 2018 for 27 hours per week (had received an extension of hours). After a conflict, I ended up on sick leave in July 2019. From September 2020 to October 2020, I reintegrated through hour build-up, after which I unfortunately fell out again. On March 30, 2022, I was officially dismissed. I know that gross FT must be converted to gross PT, that holiday pay must also be calculated and also the end-of-year bonus. But my question now is, which gross FT amount should I include in the calculation? Is that the gross FT amount in the contract I signed in 2011, or gross FT last month before first sick leave in July 2019 or most recent gross FT, so at the time of the Sickness Benefits Act, so lower gross income? I hope you can provide me with an answer

If I understand your question correctly, you say that you left employment on March 30, 2022, but how did that happen? Or do you mean to say that you were incapacitated for work for 2 years on March 30, 2022 and that the continued payment of wages only stopped? If you have been 'dismissed', you must have received a letter from the UWV or signed a document in which this is officially arranged. If neither is the case, then you are still employed. We call that a dormant employment relationship, because you are employed but no longer receive wages. If you leave employment (even after two years of incapacity for work), your employer must draw up a final settlement and this must include the transition payment. This is calculated on the basis of your last earned wages. This is not the wages during the period of illness, but what you would have received during that period if you had not been ill. Considering your question above and others, it is good to
