Can an employer keep track of productivity scores?

Questioner

On our work floor there is a scoreboard on which all productivity is described so that everyone can see who scores better or worse. Is this allowed?

Lawyer

This is probably not allowed ('just like that'). First of all, the question is whether the employer is allowed to keep such data. Secondly, the question is whether the employer (if keeping is allowed) is allowed to disclose these scores to all employees. Such actions are normally only possible if (1) there is a necessity and no less severe option (2) employees must be notified (3) beware of discrimination (4) do not continue further and longer than necessary. In this case, the employer's actions will probably hit a few brick walls. There may also be something in a collective labor agreement or information from the Works Council (if these apply to the company).
