Withdraw application, reintegration and/or work obligation exemption
Questioner
At the moment I receive social assistance due to psychological problems. A year ago, an independent Individual Psychological Examination determined that I could not work for a year; not even volunteer work. At the moment (a year later) the benefit is starting to push me towards work, and they are forcing me to continue a job coaching trajectory (which I applied for myself, but during the trajectory more is asked of me than I am capable of). Now I know that this is required according to the Participation Act; that you are obliged to cooperate if this is included in the treatment plan. My questions now are when the municipality may withdraw exemption from application, reintegration and/or work obligation, on what grounds? And whether there are also laws/articles that protect me; so that I am for example entitled to an objective medical examination in order to obtain my (partial) incapacity for work? Or are there other laws/articles that can protect my situation against the Participation Act (when there is incapacity for work that has been determined by an independent specialist)?Lawyer
Have you received a letter from the municipality stating that the application requirement has been lifted? You should object to this, in time, within six weeks. You should motivate this objection. This will lead to a reconsideration of the decision taken.Neem de volgende stap
