VVE Repair Disputes: Get Legal Advice
Questioner
Our VVE had a repair carried out without the mandatory permission of the members that exceeds the limit set in the division regulations by 3 times, while there was no urgency. No 2nd quote was requested. Also, no mandatory permission was requested to pay this from the reserve fund. The payment was not mandatory co-signed by an authorized member of the VVE. There has been no audit by an audit committee for years. The majority of the VVE still wants to grant discharge. What can we do about this?Lawyer
Within 4 weeks of learning of the decision, you can go to the subdistrict court to request that this legally valid decision be annulled. For further advice/assistance, you can contact one of the lawyers here directly without obligation, e.g. via the 'direct contact' link that you will see with this answer if you are logged in.Lawyer
If the majority of the members' meeting grants discharge, that is valid unless you contest everything in time. My colleague already indicated that you have to be quick about that. That does result in costs. If you accept that, then quickly contact a legal expenses insurer or a lawyer.Neem de volgende stap
