Who is responsible for renting a box that does not function properly?
Questioner
I am currently renting a box. There is an intermediary who acts as management for the rental. Now suddenly the door of the box opens and closes every now and then, allowing everyone to access my belongings. I have sent an email to the intermediary who acts for the landlord (also stated in my contract) that I will hold them liable if this is not resolved quickly and if items are stolen. I received the answer that they are not liable because they only do the rental and odd jobs for the VVE. There is no manager employed that I can hold responsible. The party that delivered it and possibly the supplier of the doors are. (I am renting a box and have no idea who ever delivered it). I find this a rather disturbing answer and also strange that they as landlord (I also pay them and not the owner) are not liable for anything? Please advise. Thank you very much in advance.Lawyer
This all sounds very strange indeed and I can imagine that you need some clarity. In principle, the person you rent from is responsible in such situations. It is often important what exactly is stated in the rental contract about liability and/or maintenance. In principle, the contract should also state who you can contact and/or the intermediary should make this known. For example, if only the intermediary's details are included in the contract, they usually cannot get away with it so easily by saying that it is not their problem. You may also be able to find out who the owner of the property is, for example through the land registry, by requesting an extract of the plot. Without knowing the contents of the contract it is not possible to give more concrete advice. You can contact me without obligation via my profile to discuss the matter further.Neem de volgende stap
