Termination of 2nd employment contract

Questioner

My husband was first given a 1-year contract and now a 6-month contract with the same employer. It literally says: This employment contract is entered into for a fixed term and commences on 22-01-22 and ends by operation of law, without notice being required, on 21-07-22 We think he has 1 month notice, the boss says he actually has to work until 21-7, my husband wants to take 3 weeks vacation and therefore work until March 9. How does that work?

A temporary employment contract cannot be terminated prematurely if this has not been agreed upon in the employment contract. If it has not been agreed that interim termination is possible, in principle work must be carried out until 21-07-22. In the event of interim termination, the employer can recover any damages from your husband. Does the agreement state anything about termination? It is always possible to terminate an agreement by mutual consent. In terms of vacation, an employer must usually follow the employee's wishes if sufficient vacation days have been accrued. If there are compelling business interests, an employer may refuse a long-term vacation. Did the employer refuse the vacation?
