Objecting to a reduction in AOW

Questioner

I am now 76 years old, and have been receiving AOW for 65 years: permanently separated (unmarried for tax purposes), legally separated since 1990, In October 2021, I suddenly had to answer questions during a home visit by the SVB's supervisory body. Due to the rude attitude of these employees, I ended the conversation prematurely, with their promise that I would receive a report of the conversation and a questionnaire. I didn't hear anything for 5 months, until today I saw that my AOW pension has been reduced and that from 2016 I have to pay back the 'overpaid', namely E25,228.92!! 2016 is a date on which nothing changed and seems to have been plucked out of thin air! With my very modest income, there is no way I can afford all this! The reason given is that, according to them, I am not permanently separated because my ex, who lives in the North of Friesland, and I saw each other 'regularly' (around birthdays and when doing odd jobs for each other). I am totally panicked and especially angry about the injustice of this, of course I want to 'Object', but I need legal help, to know what and how I should fight it! Hope to be able to make an appointment with an employee of the legal aid soon!

It is indeed important to appeal this decision and request the file. This allows us to see on what grounds this decision was taken and motivated. The grounds for the objection can be further supplemented on the basis of the file. You clearly indicate that you have been living separately and that the decision to reclaim the amount was therefore wrongly taken.
